Please read these Terms of Service ("Terms", "Agreement") carefully before creating an account or using the Park Director software application, website, and planning tools (collectively, the "Service"), operated by the owner, operating as a sole trader in Ontario, Canada ("us", "we", "our").
By creating an account, accessing, or using the Service, you confirm that you are at least 18 years of age and agree to be bound by these Terms. If you do not agree to these Terms, you are not authorized to use the Service.
1. Eligibility and Account Creation
- Age Requirement: You must be at least 18 years of age to create an account and use this Service. By registering, you represent and warrant that you meet this age requirement. If we discover that a user under 18 has created an account, we reserve the right to terminate the account and delete all associated data immediately without notice.
- Account Security: You must provide accurate, current, and complete information during registration. You are solely responsible for maintaining the confidentiality of your account credentials (including passwords and authentication tokens) and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breaches.
2. Fees, Premium Tiers, and Future Changes
- Current Free Access: The Service is currently provided to you free of charge.
- Right to Modify Pricing: We explicitly reserve the right to introduce fees, subscription models, or premium paid tiers for the Service, or for specific features within the Service, at any time.
- Notice of Fees: We will provide you with reasonable advance notice via email or an in-app notification before any such fees become effective. If you do not wish to pay the introduced fees, your sole remedy will be to cancel and terminate your account before the billing period begins.
3. Intellectual Property and Trademark Disclaimer
- Our Property: We own all rights, titles, and interests in and to the Service, including but not limited to the software code, application layout, design, graphics, branding, and user interface features. These are protected by Canadian and international copyright, trademark, and intellectual property laws.
- Non-Affiliation and Trademark Disclaimer: Park Director is an independent planning application and is not affiliated with, authorized, maintained, sponsored, endorsed by, or in any way officially connected with The Walt Disney Company, Disney Enterprises, Inc., or any of their affiliates, subsidiaries, or related companies. All official names, trademarks, service marks, and trade names—including but not limited to "Walt Disney World®"—are the registered property of Disney Enterprises, Inc., or their respective owners. Use of these trademarks within the Service is strictly for informational, educational, and planning purposes under fair use principles, and does not imply any association with or endorsement by the trademark owners.
- Your Content: You retain ownership of any data, trip plans, wishlists, reservations, or group information that you upload or input into the Service ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, transfer, display, and process your data solely for the purpose of providing the Service to you.
4. Collaborative Features and Link-Based Invitations
- User-Generated Invite Links: The Service allows you to generate unique URLs to share your planning dashboards with friends and family. You are solely responsible for the distribution of these links. Anyone with access to an invitation link may be able to view your plans or request account access to join your group.
- Shared Content Liability: Any data, reservations, or comments uploaded to a shared group space will be visible to all authorized members of that group. We are not responsible for how other group members use, copy, or distribute the data you share within the app.
- Group Management Actions: Group members with administrative privileges have the ability to edit, modify, or permanently delete shared trip itineraries or remove other users. You agree that Park Director is not liable for any data loss, deleted plans, or coordination disruptions caused by the actions of other members in your shared group.
5. Third-Party Infrastructure and Services
- Data Processing Stack: The Service relies on external infrastructure and third-party vendors to operate, including but not limited to Clerk (Authentication/Identity), Neon (Database), Railway (API Hosting), PostHog (Product Analytics), and Cloudflare (CDN/DNS).
- Limitation of Infrastructure Liability: You acknowledge and agree that we do not own, control, or operate these third-party services. We are not liable for any service interruptions, server downtime, database corruption, data breaches, or performance failures caused directly or indirectly by these third-party vendors. Your interaction with any third-party infrastructure is subject to their respective terms and policies.
6. Acceptable Use Policy
You agree not to use the Service to:
- Reverse-engineer, decompile, or attempt to extract the source code of Park Director.
- Scrape, crawl, or extract data from the Service using automated tools.
- Upload malicious code, viruses, or software intended to disrupt the Service or database infrastructure.
- Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
7. Disclaimer of Warranties and Data Accuracy
- As-Is Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Accuracy of Park Information: The Service provides planning tools based on data related to theme parks, attractions, schedules, and pricing. While we strive to provide helpful data, all information presented within the Service is believed to be accurate at the time of publishing but is not guaranteed. Theme park attractions, operating hours, wait times, pricing, ticketing, and operational policies are subject to rapid change by their respective operators without notice. You acknowledge that any reliance on the information provided by the Service is at your own risk. For official, real-time, and legally binding park information, you are solely responsible for verifying details directly via official channels (e.g., ://go.com). We do not warrant that the Service will be uninterrupted, error-free, completely secure, or that any planning data will be permanently preserved without loss.
8. Limitation of Liability
To the maximum extent permitted by the laws of Ontario and Canada, in no event shall [Your Full Legal Name], operating as Park Director, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of (or inability to access or use) the Service.
- Any conduct or content of any third party on the Service.
- Any unauthorized access, use, or alteration of your transmissions or data.
- Technical failures of our third-party infrastructure providers.
- Any financial losses, missed park reservations, cancellation fees, travel disruptions, or emotional distress resulting from inaccurate park data, ride closures, or scheduling conflicts generated through the use of the Service.
Because the Service is currently free of charge, our total liability for any claims under these Terms shall be limited to $0.00 CAD (or a maximum cap of $10.00 CAD).
9. Data Export and Termination
- Account Deletion: You may stop using the Service and delete your account at any time.
- Our Right to Terminate: We reserve the right to suspend or terminate your account at our sole discretion, without prior notice or liability, for any breach of these Terms.
- Data Deletion: Because this is a planning tool, you are solely responsible for exporting or maintaining backups of your critical data. Upon account termination by either party, we are under no obligation to retain or forward your planning data, and it may be permanently and irreversibly deleted from our primary and third-party databases.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any legal action, suit, or dispute arising out of or relating to these Terms or the Service must be brought exclusively in the courts located in Toronto, Ontario, Canada, and you hereby irrevocably submit and attorn to the personal jurisdiction of such courts.
11. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
